1. 適用 (Agreement)

1. ユーザーは、本サービスをダウンロード、インストール、または利用することにより、本規約に同意したものとみなされます。
2. ユーザーが未成年者である場合は、親権者等の法定代理人の同意を得た上で本サービスをご利用（特に有料プランの購入）ください。

2. 知的財産権およびコンテンツの帰属 (Intellectual Property)

1. 本サービスに関するプログラム、UI/UXデザイン、ロゴ、プリセットLUT、テキスト等の知的財産権は、すべて当事業所または正当な権利を有する第三者に帰属します。
2. ユーザーが本サービスを用いて自ら撮影・現像・編集・作成した写真および画像データの権利は、すべて当該ユーザーに帰属します。
3. ユーザーが本サービスにインポートして使用するLUT（.cubeファイル等）その他の外部データについて、ユーザー自身が正当な使用権原を有していること、および第三者の知的財産権その他の権利を侵害していないことを保証するものとします。インポートされたデータに起因して生じた紛争について、当事業所は一切の責任を負いません。

3. 有料プラン (Purchases & Subscriptions)

Rarecamでは、高度な機能をご利用いただくための有料プラン（買い切り版および定期購入サブスクリプション）を提供しています。

買い切り版（Lifetime / Founder's Edition）

一度のお支払いで対象機能を永続的にご利用いただけます。当事業所は数量限定または期間限定の特別プラン（Founder's Edition等）を提供する場合がありますが、付与される機能および権利は通常のLifetimeに準じます。同一のプラットフォームアカウント（Googleアカウント等）であれば、機種変更時も再購入なしで復元可能です。なお、Lifetimeは本サービスが提供・運営されている期間中の利用を指し、将来にわたる無期限のOS互換性保証や永久のサービス継続を約束するものではありません。

サブスクリプション（定期購入）

選択された請求期間（月額/年額等）ごとに自動更新され、アプリストア（Google Play等）を通じて請求が行われます。

解約方法

次回更新日の24時間前までに、アプリストアのアカウント設定（Google Playの場合は「お支払いと定期購入」＞「定期購入」）から自動更新の解除を行ってください。アプリをアンインストール・削除しただけでは解約されません。

返金について

デジタルコンテンツの特性上、購入完了後のキャンセル・返金はお受けできません。返金の可否および手続きは各アプリストアの返金ポリシーに従います。

4. 禁止事項 (Prohibited Conduct)

ユーザーは、本サービスの利用にあたり、以下の行為を行ってはなりません。

1. 本サービスのリバースエンジニアリング、逆コンパイル、逆アセンブル、ソースコードやアルゴリズムの抽出
2. 違法、無断、または不正な盗撮・監視・録画等を目的とした利用
3. 当事業所または第三者の著作権、商標権、肖像権、プライバシーその他の権利を侵害する行為
4. 法令、裁判所の判決、または公序良俗に反する行為
5. 本サービスの運営やサーバー・ネットワークに過度な負荷をかける行為

5. サービスの変更・中断・終了 (Service Changes & Termination)

当事業所は、保守点検、システム障害、事業上の判断その他やむを得ない事由がある場合、ユーザーへの事前の通知なく、本サービスの全部または一部の提供を変更、中断、または終了することができます。

6. 免責事項 (Disclaimer)

1. 当事業所は、本サービスに事実上または法律上の瑕疵（安全性、信頼性、正確性、完全性、有効性、エラーやバグがないこと等）がないことを明示的にも黙示的にも保証しません。
2. 本サービスの利用に起因してユーザーに生じた損害について、当事業所に故意または重過失がある場合を除き、当事業所が負う賠償責任は、直接かつ通常生ずべき損害に限定され、その賠償額は当該ユーザーが本サービスに対して過去12ヶ月間に支払った利用料金の総額（無料利用の場合は金1,000円）を上限とします。

7. 規約の変更 (Modifications)

当事業所は、必要と判断した場合には、本規約を変更できるものとします。変更後の利用規約は、本サービスの公式ウェブサイトまたはアプリ内への掲示その他適切な方法により周知した時点から効力を生じるものとします。

8. 準拠法・裁判管轄 (Governing Law & Jurisdiction)

本規約は日本法に準拠し、日本法に従って解釈されます。本サービスに関して生じた一切の紛争については、東京簡易裁判所または東京地方裁判所を第一審の専属的合意管轄裁判所とします。

1. Agreement & Eligibility

By downloading, installing, or using the Service, you agree to be bound by these Terms. If you are a minor, you must obtain the consent of your parent or legal guardian before using the Service (especially when purchasing paid plans).

2. Intellectual Property & Content Ownership

All intellectual property rights in the Service (including software, UI/UX designs, logos, presets, and text) belong to us or our licensors. You retain all rights to any photos, videos, images, or media you capture, process, or create using the Service.

You represent and warrant that any external files or LUTs (.cube files) imported into the Service do not infringe on any third party's intellectual property or proprietary rights. We assume no liability for disputes arising from user-imported content.

3. Purchases & Subscriptions

Rarecam offers paid options (one-time Lifetime purchases and auto-renewing Subscriptions) for advanced features.

Lifetime Purchase (One-time / Founder's Edition)

A single payment grants access to premium features for the lifetime of the Service. We may offer limited-quantity or promotional tiers (such as the "Founder's Edition"), which provide the same lifetime feature rights. Purchases can be restored on devices using the same platform account (e.g., Google Account). "Lifetime" refers to the operational lifespan of the Service and does not guarantee indefinite future OS compatibility or perpetual service operation.

Subscriptions (Auto-Renewal)

Subscriptions automatically renew at the end of each billing cycle (e.g., monthly, yearly) and are charged through your app store account (e.g., Google Play).

Cancellation

To cancel auto-renewal, turn off subscriptions in your app store account settings (for Google Play: "Payments & subscriptions" > "Subscriptions") before the next billing date. Uninstalling the app does not automatically cancel your subscription.

Refunds

Due to the nature of digital content, all purchases are generally non-refundable. Refund requests and eligibility are governed strictly by the policies of the applicable app store.

4. Prohibited Conduct

You agree not to engage in any of the following activities:

• Reverse engineering, decompiling, disassembling, or attempting to extract the source code or algorithms of the Service.
• Using the Service for unlawful, covert, or unauthorized surveillance or recording.
• Infringing on our or any third party's copyright, trademark, portrait rights, privacy, or other proprietary rights.
• Violating any applicable laws, regulations, court orders, or public order.
• Imposing an unreasonable or disproportionately large load on our systems or networks.

5. Service Changes & Termination

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without prior notice due to maintenance, technical updates, system failures, or business determinations.

6. Disclaimer & Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ERROR-FREE OPERATION, SECURITY, ACCURACY, OR FITNESS FOR A PARTICULAR PURPOSE.

Except in cases of our intentional misconduct or gross negligence, our total liability for any damages arising out of or related to your use of the Service shall be limited to direct and actual damages, not to exceed the total amount paid by you for the Service during the preceding 12 months (or JPY 1,000 in the case of free use).

7. Modifications to Terms

We may revise these Terms from time to time. If a revision is material, we will make reasonable efforts to provide notice prior to the new terms taking effect. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

8. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan. Any disputes arising out of or in connection with the Service shall be subject to the exclusive jurisdiction of the Tokyo Summary Court or the Tokyo District Court as the court of first instance.
